This Policy applies to the Papa Johns Bulgaria sites and apps.
Please read these terms of use carefully before downloading our applications and / or using our service.
This document (referred to as "Terms of Use" and "General Terms and Conditions") contains the general conditions of the Site Owner (as defined below) for the use of the website www.papajohns.bg.
All elements of the website www.papajohns.bg, including design, databases, text, drawings, graphics, sketches, and other information or elements, except for those placed by users and advertisers, are subject to copyright within the meaning of the Copyright and Related Rights Act and are the property of “IAmFresh” Ltd., registered at: Stara Zagora, 20 Gladston str., ap. 5, UIC 207498515, the operator of the Papa Johns chain in Bulgaria (also referred to as "Site Owner" or "Papa Johns Bulgaria").
The use of graphic and video materials published on the site is strictly prohibited without the prior consent of the owner. Violators will be sanctioned to the full extent of the law.
"Services" are the services provided by the owner, including the presentation of products, delivery, and promotional campaigns.
"Website/Site" is a specific place on the global Internet network, accessible through its uniform address (URL) via the HTTP, HTTPS, or other standardized protocol, and containing files, programs, text, sound, images, or other materials and resources.
"User" is any individual who uses the services provided by the owner.
"Malicious and Unfair Actions" are actions or inactions that violate Internet etiquette or cause harm to individuals connected to the Internet or associated networks, such as sending unsolicited mail (SPAM, JUNK MAIL), flooding channels (FLOOD), gaining access to resources using foreign rights and passwords, exploiting system vulnerabilities for personal gain or obtaining information (HACKING), actions that can be classified as industrial espionage or sabotage, or causing the installation of viruses or remote control systems, disrupting the normal operation of other Internet users and associated networks, and performing any actions that may be classified as a crime or administrative violation under Bulgarian law or the laws of another country.
"Delivery" – the transfer of an order, packed in a suitable form for transportation, and the transportation of the order to the address provided by the customer.
"Web page" in the context of these General Terms and Conditions means a separate and distinct part of a website.
"Force Majeure" is an unforeseen or unforeseeable event at the time of entering into the contract, of an extraordinary nature, which makes the provision of services objectively impossible.
"User Account" is a designated section within www.papajohns.bg, containing information about the user provided during registration and stored by www.papajohns.bg. Access to the user account is granted through a username and password. The account allows the user to view and edit the data entered during registration, access their personal mailbox, change their access password, subscribe or unsubscribe to the newsletter, and more.
"Username" is a unique code of letters and/or numbers chosen by the user to identify them on www.papajohns.bg.
"Password" is a code of letters and/or numbers chosen by the user, which, together with the username, identifies the user.
"Server" is a device or system of connected devices on which system software is installed to perform tasks related to storing, processing, receiving, or transmitting information.
2.1 The Owner has the right to change the design, format, technology, and services provided by the websites without prior notice to users.
2.2 The Owner has the right, at their discretion, to remove part of the services they offer or to restrict access to them for all or specific users.
2.3 The Owner has the right, in cases of breach of contractual obligations, malicious actions, inappropriate comments, or other actions incompatible with morality and good business practices, to delete, restrict, and/or terminate the information of any user without the right to appeal.
2.4 The Owner has the right to seek liability and impose sanctions related to the services provided if they receive notification of a violation on the site from the authorized authorities under Bulgarian law or in cases where a user violates contractual terms, engages in malicious actions, makes inappropriate comments, and/or performs other actions that are incompatible with morality and good business practices.
2.5 The Owner has the right to offer space on their websites for sale to advertisers and to display, show, send, load, and perform advertisements and promotional materials for their own purposes or for the purposes of their clients.
2.6 The Owner has the right to generate and send synthesized information to the email address provided by the user regarding updates to the services offered, in the form of a newsletter, weekly menu, or current promotions.
2.7 The Owner is obligated to provide the user with a clear and unambiguous way to opt-out of receiving the communications described in point 2.6.
2.8 The user's right of access does not include the right to copy or reproduce information, materials, and resources, or to use intellectual property objects, except in the case of small volumes of information intended for personal use, provided that the legitimate interests of authors or other intellectual property rights holders are not unreasonably harmed, and that the copying or reproduction is done for non-commercial purposes.
2.9 The user has the right to specify an email address where they would like to receive synthesized information about updates published on the Owner's website in the form of a newsletter.
2.10 The user has the right to opt-out via the methods provided by the Owner in accordance with point 2.7. However, opting out of receiving communications will prevent the user from participating in promotional offers that require sending vouchers and/or feedback.
2.11 The user is required to notify the Owner in advance, in an appropriate manner, if the email address used for registration is listed in the register of legal entity email addresses that do not wish to receive unsolicited commercial communications.
3.1 Papa Johns Bulgaria provides the services described in these General Terms and Conditions ("Services") to USERS through the website www.papajohns.bg in an online mode, provided that the USER strictly adheres to the requirements specified in these General Terms and Conditions.
3.2 Some of the Services on the website www.papajohns.bg are available to all USERS without requiring prior registration. These include, but are not limited to, access to and use of various informational resources available on www.papajohns.bg—such as news, promotions, an event calendar, and the current menu of items or other content provided by www.papajohns.bg—subject to the rules of these General Terms and Conditions.
3.3 The use of certain Services on www.papajohns.bg is only possible after prior registration, creation of a USER profile, and entering a username and password. These Services are addressed to and offered only to individuals who are 18 (eighteen) years of age or older.
4.1 These General Terms and Conditions apply to relationships with USERS who have registered on the website www.papajohns.bg ("registered USERS"). These General Terms and Conditions also apply to relationships with USERS who have not registered on the website www.papajohns.bg ("unregistered USERS"), with their rights limited to using the services described in section 3.2.
4.2 The text of these General Terms and Conditions is available on the Internet at the address http://papajohns.bg in a manner that allows it to be stored and reproduced. An electronic link to the webpage containing the text of these General Terms and Conditions is located on every page of the website www.papajohns.bg. By using the services and resources of the website www.papajohns.bg, including opening a webpage from www.papajohns.bg or clicking on an electronic link from the homepage or any other page of www.papajohns.bg, USERS declare that they are familiar with these General Terms and Conditions, agree to them, and undertake to comply with them.
4.3 To use the services described in section 3.3 of these General Terms and Conditions, the USER must first register by completing the relevant online registration form available in real-time on the website www.papajohns.bg.
4.3.1 During the registration process, by checking the box labeled "I have read and accept the Terms of Use and Privacy Notice and confirm that I am 18 years old" and clicking the virtual "Register" button, the USER makes an explicit electronic declaration in accordance with the Electronic Document and Electronic Signature Act, stating that they are familiar with the Terms of Use and Privacy Notice published on the website www.papajohns.bg, accepts them, agrees to them, and undertakes to comply with them.
4.3.2 Upon registration, the USER gains access to all services offered by www.papajohns.bg. When filling out the registration form, the USER is required to provide complete and accurate information regarding their identity and other details required by the electronic form on www.papajohns.bg, and to update this information immediately upon any changes. The USER guarantees that the data provided during registration is accurate, complete, and correct, and will update it promptly if there are any changes.
4.3.3 If the required personal data is not provided in the registration form, www.papajohns.bg has the right to refuse registration.
4.3.4 In the case of providing incorrect data or failure to reflect changes, www.papajohns.bg has the right to terminate or suspend the provision of services immediately and without notice, as well as to terminate the registration. In this case, the termination of the services is considered an automatic termination of the contract.
5.1 During registration, the USER specifies a username and password. If the username is not already taken, the USER will receive the username and password they selected. With these credentials, the USER gains access to their User Profile and the ability to use the services described in section 3.3.
5.2 The username is a unique code of letters, numbers, and symbols used to identify the USER when using the services described in section 3.3. www.papajohns.bg does not verify or assume responsibility for whether the username matches the USER's name, whether it infringes on the rights of third parties, including the right to a name or other personal rights, business names (trademarks), registered trademarks, or other intellectual property rights.
5.3 The password is a code of letters, numbers, and symbols that, together with the username, provides access to a specific user profile.
5.4 The USER must not disclose their password or the answers to security questions to third parties and must immediately notify www.papajohns.bg in the event of unauthorized access or the likelihood of such access. The USER is required to take all reasonable precautions and measures to protect their password and security questions and answers and is fully responsible for all actions taken by them or by third parties using these credentials.
5.5 The User Profile is a designated part of the website www.papajohns.bg, containing information about the registered USER, provided during registration and stored on a server at www.papajohns.bg. Through their User Profile, the USER can use, configure, activate, or deactivate various services described in section 3.3 of www.papajohns.bg, manage content they have placed on the server of www.papajohns.bg, update the registration information, change their password and security questions and answers, terminate their registration on www.papajohns.bg, and more.
5.6 Each USER may have only one active User Profile. Registration under a fictitious name or another person's name (using another identity) is prohibited. www.papajohns.bg may refuse to register an individual if they receive information that the individual is providing false or third-party data.
6.1 The agreement between the parties becomes effective from the moment of reaching an agreement, as evidenced in the manner described in sections 4.2 or 4.3.1.
6.2 The agreement is concluded in the Bulgarian language.
6.3 The agreement is valid:
a) For unregistered USERS – until the cessation of use of the services described in section 3.2.
b) For registered USERS – for an indefinite period from the registration of the USER until the termination of the agreement in accordance with the provisions of these General Terms and Conditions.
7.1 The owner provides the food delivery service to homes and offices within Sofia.
7.2 Orders for delivery are accepted online via the website, through a company phone specifically designated for order taking (0700 91190), or through other communication means or mobile or web-based applications provided by the Papa Johns Bulgaria website.
7.3 Deliveries are carried out by authorized employees of the respective Papa Johns Bulgaria restaurant.
7.4 The delivery of ordered items is made to the exact address provided by the user, as well as to a provided phone number for feedback.
7.5 Delivery of the ordered items is performed within 30 (thirty) minutes from the acceptance of the order. In cases of force majeure (such as severe weather conditions, traffic accidents, etc.), the delivery time may be indefinite, or the order may be canceled by the owner.
7.6 The order subject to delivery is transported and delivered appropriately packaged and within reasonable timeframes depending on the time of day and the workload of Papa Johns Bulgaria restaurants.
Delivery Hours: Every day from 11:00 AM to 11:00 PM
Applies to areas in Sofia serviced by the home delivery service of Iamfresh Ltd / Papa Johns Bulgaria.
Minimum Order Amount: 18 (eighteen) leva in products, excluding the delivery fee. All prices listed in the menu are in Bulgarian leva.
Delivery Fee: 2.99 leva.
Payment: Payment upon delivery is only accepted in cash and in Bulgarian leva. Vouchers, checks, and cards are not accepted. Card payment is available when creating an order online via the mobile application or our website.
Service Areas in Sofia by Papa Johns Bulgaria: Manastirski Livadi, Gotse Delchev, Motopista, Borovo, Krasno Selo, Mladost 1A, Mladost 2, Mladost 3, Hadji Dimitar, Orlandovtsi, Birimirci, Voenna Rampa, Malashevtsi.
7.7 Iamfresh Ltd / Papa Johns Bulgaria reserves the right to change the prices and weights of items, as well as the delivery areas.
7.8 The cost of telephone calls is charged at the standard rate per minute between the respective operator of the User and A1 (the mobile operator of Papa Johns Bulgaria), with no free minutes applicable to subscribers.
7.9 In the event that a User places an order for delivery outside of the delivery area, or if there is an inability or difficulty in delivering, the User will be promptly informed.
7.10 For the "TAKE AWAY" service, there is no minimum order value requirement.
To determine the preparation time for the order, the User has the option to select "now" or specify a later time for pick-up. If "now" is selected, the approximate preparation time is 20 minutes. Depending on the current workload of the chosen restaurant, this time may be extended. Upon finalizing the order, the User receives information about the expected preparation time and has the option to confirm or cancel the order if they do not agree with the time provided.
The User is required to arrive at the selected restaurant within the expected preparation time to collect the order. If the User is late by more than 15 minutes, Papa Johns Bulgaria has the right to contact them to clarify the reason for the delay. If the User is late by more than 60 minutes, Papa Johns Bulgaria has the right to cancel the order.
8.1 Links to the General Terms and Conditions are located at the bottom of the Owner’s websites.
8.2 In view of the periodic updates and modifications of the Services, their improvement and expansion, as well as potential legislative changes that affect them, the General Terms and Conditions may be unilaterally amended by Papa Johns Bulgaria. This amendment may occur due to changes in the type, nature, or technology of the Services provided, termination of certain Services, or changes in economic conditions.
8.3 By submitting a request and receiving a response for loading, regardless of the user’s geographical location, including through indirect loading via the use of hyperlinks ("electronic link" as defined by the Electronic Commerce Act), banners, and/or other appropriate means in accordance with the used technology, from another website, as well as through voluntary registration, the user makes an electronic declaration in accordance with the Electronic Document and Electronic Signature Act. This declaration indicates that the user wishes to use the services provided by the Owner, acknowledges these General Terms and Conditions, and agrees that they have the force of a contract that must be observed in the relationship between the user and the Owner.
8.4 The General Terms and Conditions are effective from the moment of the user’s electronic declaration until the cessation of the use of the Owner's services by leaving the respective website. Each new login constitutes a new agreement.
8.5 In case of amendments and/or additions to the General Terms and Conditions, the Owner will notify users of the changes in an appropriate manner by publishing a notice of the changes and/or additions on a prominent place on its website. The notice of changes and/or additions, along with the text of the changes, will be published no later than 14 (fourteen) days before the changes and/or additions come into effect.
8.6 The General Terms and Conditions come into effect from the date of their publication and last update.
8.7 These General Terms and Conditions, as well as any future amendments to them, apply to existing registered USERS as of the date they come into effect. During the period specified in 8.5, they have the opportunity to notify Papa Johns Bulgaria that they reject the changes by sending a message. If no rejection statement is received by Papa Johns Bulgaria, it is considered that the USER is bound by the changes. A registered USER’s declaration of disagreement with the changes will result in the automatic termination of the contract between the USER and Papa Johns Bulgaria for using the services provided through the website www.papajohns.bg. In such a case, Papa Johns Bulgaria has the right to immediately suspend the user’s access to their profile, terminate their registration, and delete all user content from its servers.
9.1 The USER is responsible for providing the necessary client equipment (end devices for accessing the Internet and corresponding software applications) and Internet access for using the services provided by Papa Johns Bulgaria.
9.2 The USER has the right to online access to the services provided through the website www.papajohns.bg, subject to the conditions and requirements for access set by Papa Johns Bulgaria.
9.3 The USER undertakes not to upload, place on Papa Johns Bulgaria’s server, or make available in any way to third parties any User Content – information, data, text, messages, or any other materials or electronic links to materials:
a) Contradicting Bulgarian legislation, applicable foreign laws, these General Terms and Conditions, Internet etiquette, rules of morality, and good manners;
b) Containing violence (including violence against animals), incitement to violence, humiliation of human dignity, threats to life and physical integrity;
c) With pornographic or explicitly sexual content;
d) Containing clearly identifiable bodies of victims from accidents and other severe incidents;
e) Offending any religion or containing religious propaganda;
f) Representing commercial or trade secrets or other confidential information;
g) Subject to intellectual property rights of third parties, unless with the consent of the rights holder;
h) Violating any property or non-property rights or legal interests of third parties;
i) Promoting discrimination based on sex, race, educational level, age, and religion or advocating fascist, racist, or other undemocratic ideologies;
j) Defaming others and calling for violent change of the constitutional order, committing a crime, violence against individuals, or inciting racial, national, ethnic, or religious hatred;
k) Containing information urging or facilitating terrorist activities;
l) Containing information about foreign passwords or access rights without the consent of the rights holder, as well as software for accessing such passwords or rights.
9.4 The USER undertakes when using the services provided by Papa Johns Bulgaria:
a) Not to engage in malicious actions as defined in these General Terms and Conditions;
b) To immediately notify Papa Johns Bulgaria of any instance of violation or discovered violation during the use of the provided services;
c) Not to impersonate another person;
d) Not to use methods that lead to the forced loading of unwanted content ("pop-up", "blind link", and similar).
9.5 The USER has the right at any time, at their own discretion, to terminate the use of the services provided by Papa Johns Bulgaria by deactivating their provision from their User profile or another designated web page, or by terminating their registration on the website www.papajohns.bg, respectively ceasing to use the services as per 4.2. From the moment of termination of registration, and for non-registered USERS – from the moment of cessation of use of the services as per 4.2, the contract between the parties is considered automatically terminated, and Papa Johns Bulgaria will stop the corresponding USER’s access to their User profile and has the right to stop access to and delete from its servers all User Content in accordance with 15.2 of these General Terms and Conditions. Deactivating the provision of specific services does not lead to the termination of the contract.
9.6 The USER may access and use any content published on the website www.papajohns.bg, including User Content, only for personal, non-commercial purposes in accordance with the requirements of these General Terms and Conditions.
9.7 The USER undertakes not to access or attempt to gain unauthorized access to the services provided by www.papajohns.bg through intercepting and using foreign passwords or any other methods, not to bypass, damage, or otherwise disrupt the normal operation of technical or software applications on the website www.papajohns.bg, which prevent or limit access to foreign email boxes, administrative panels, computer systems, and networks related to the provided services.
10.1 Papa Johns Bulgaria is obligated to exercise due care in providing the USER with the normal use of the Services.
Policy for Accepting and Handling Complaints by Papa Johns Bulgaria
10.1.1 Papa Johns Bulgaria guarantees the taste characteristics and nutritional quality of the delivered products within 2 (two) hours from the time of the order. Therefore, Papa Johns Bulgaria recommends consuming the delivered products within the specified period. After this period, Papa Johns Bulgaria is not responsible for the taste characteristics and nutritional quality of the delivered products.
10.1.2 In the event of a discrepancy between your order and the delivered products in terms of quantity and quality, you have the right to file a complaint in accordance with the Consumer Protection Act. To file a complaint, you must notify us within 60 minutes from the time of delivery of your order, with the notification considered filed through a phone call to the national Call Center at 0700 91190. If your complaint notification is made after this period, Papa Johns Bulgaria is not obligated to follow the complaint acceptance policy.
10.1.3 In the event of a valid complaint from your side, we offer the following options for resolving the identified issue depending on the situation, type, and nature of the problem:
- We will deliver the incorrect or missing product with a new one as soon as possible within the same day/next day or we will provide you with loyalty points in your application equivalent to the value of the incorrect or missing product plus 10 additional points within 3 working days.
10.1.4 In all cases of inaccurate fulfillment of your order, except for cases related to undelivered items/products, your complaint will be considered valid only if you present to the delivery person the product you are dissatisfied with, in an amount no less than two-thirds of the delivered quantity. On the other hand, if the customer has discarded the order or returns less than two-thirds of the provided quantity, Papa Johns Bulgaria is not responsible for compensation.
10.1.5 This Complaint Acceptance and Handling Policy does not apply in cases of force majeure, including adverse weather conditions.
10.2 Papa Johns Bulgaria is not obligated and objectively unable to control how the USER uses the provided services and is not responsible for the purposes and activities of the USER in connection with the use of the services, as well as the nature and content of User Content. Papa Johns Bulgaria is not obligated to monitor the information stored on its servers or made available while providing the services, nor to search for facts and circumstances indicating the commission of illegal activities by the USER through the use of the services.
10.3 In accordance with the requirements of Bulgarian legislation, Papa Johns Bulgaria stores informational materials and resources placed by the USER on the server of www.papajohns.bg and has the right to provide them to the competent state authorities when necessary to protect the rights, legal interests, and security of Papa Johns Bulgaria or third parties, as well as in cases when such information is requested by relevant state authorities in accordance with the law.
10.4 Papa Johns Bulgaria has the right to send commercial messages to USERS for the purpose of offering information and advertisements regarding its own or goods/services offered by other commercial entities, to make inquiries on various matters, conduct surveys, and more. By accepting these General Terms and Conditions, the USER agrees to receive commercial messages from Papa Johns Bulgaria.
10.5 Papa Johns Bulgaria has the right, but not the obligation, to at its discretion and without prior notice, suspend access to and/or remove User Content when it contradicts the requirements set forth in these General Terms and Conditions.
11.1 Papa Johns Bulgaria takes care to provide the USER with the opportunity for normal use of the services, but since the services are provided free of charge, it is not obligated and does not guarantee that they will meet the USER’s requirements, nor that they will be uninterrupted, timely, or secure. By accepting these General Terms and Conditions, the USER declares that the use of the provided services will be entirely at their own risk and responsibility, and the parties agree that Papa Johns Bulgaria is not liable for any damages that may be caused to the USER from the use of the provided services.
11.2 Papa Johns Bulgaria is not responsible for failure to provide services in the event of circumstances beyond its control – in cases of force majeure, accidental events, problems in the global Internet network and in providing services beyond Papa Johns Bulgaria’s control, issues related to the USER’s equipment, as well as in cases of unauthorized access or interference by third parties in the operation of Papa Johns Bulgaria’s information system or servers.
11.3 Papa Johns Bulgaria is not liable for damage to the USER’s software, hardware, or equipment, or for data loss arising from materials or resources sought, loaded, or used in any way through the provided services.
11.4 Papa Johns Bulgaria is not liable to the USER and third parties for damages and lost profits resulting from the termination, suspension, modification, or limitation of the provision of any of the services provided, including the deletion, return, non-receipt, modification, loss, inaccuracy, or incompleteness of items, messages, materials, or information used, recorded, or made available through the website www.papajohns.bg.
11.5 The parties agree that Papa Johns Bulgaria is not responsible for failure to provide services or for degraded service quality due to tests conducted by Papa Johns Bulgaria to check equipment, connections, networks, and other aspects, as well as tests aimed at improving or optimizing the provided services. In such cases, Papa Johns Bulgaria will notify the USER in advance of possible temporary non-provision or degraded quality of the services.
11.6 By accepting these General Terms and Conditions, the USER acknowledges the possibility of potential interruptions and other difficulties in establishing an Internet connection to the website www.papajohns.bg, which may occur regardless of the care taken by Papa Johns Bulgaria. The USER declares that they will not claim any compensation from Papa Johns Bulgaria for lost profits, damages, or inconveniences resulting from the mentioned interruptions or difficulties in the Internet connection, including regarding the capacity of this connection.
11.7 Papa Johns Bulgaria is not responsible and does not owe compensation to any individual whose personal data has been used by another person for the use of the services provided by Papa Johns Bulgaria, whether consent was given or not.
12.1 Papa Johns Bulgaria has the right to suspend, limit, or change the services provided to the USER, as well as to notify the relevant state authorities, if, in the opinion of Papa Johns Bulgaria, the USER's behavior violates provisions of Bulgarian legislation, these General Terms and Conditions, or the rights and legal interests of third parties. Additionally, Papa Johns Bulgaria may, at any time and without prior notice, suspend access to any content posted by the USER on the website www.papajohns.bg that it deems, or is informed by third parties, to be in violation of Bulgarian law, these General Terms and Conditions, or any intellectual property rights, until such a dispute is resolved by a competent state authority.
12.2 Upon receiving an order from competent state authorities regarding User Content, Papa Johns Bulgaria has the right to suspend access to such User Content or take other actions as required by the order, without prior notice.
12.3 Papa Johns Bulgaria has the right, without prior notice, to deactivate the password for accessing the USER's profile if, in the opinion of Papa Johns Bulgaria, the USER is violating provisions of Bulgarian legislation, these General Terms and Conditions, or the rights and legal interests of third parties. In such cases, Papa Johns Bulgaria has the right to terminate the USER's registration, suspend the provision of services as per section 3.3, and delete all User Content posted by the USER from its servers. The contract with the USER is considered automatically terminated from the date of termination of their registration.
12.4 When Papa Johns Bulgaria receives information giving sufficient grounds to suspect that the USER's behavior while using the services on the website www.papajohns.bg might constitute a criminal offense or administrative violation, Papa Johns Bulgaria has the right, at its discretion, to notify the competent state authorities, providing necessary assistance and all required information and materials as requested by the authorities, which may help in identifying the perpetrator and proving the committed crime or administrative violation.
12.5 In the cases mentioned above, Papa Johns Bulgaria is not responsible for any damages or lost profits incurred by the USER or third parties due to the suspension, modification, or limitation of the services, termination of the contract, or providing information or executing orders from competent state authorities.
13.1 The USER is obligated to indemnify Papa Johns Bulgaria and all third parties for any damages and lost profits, including paid property penalties, attorney fees, and other costs, resulting from claims made by and/or paid compensations to third parties concerning materials that the USER has made available to third parties or made accessible through the use of services provided by Papa Johns Bulgaria, in violation of Bulgarian legislation, applicable foreign laws, these General Terms and Conditions, or public morals, as well as for other breaches of obligations under these General Terms and Conditions.
13.2 Additionally, the USER is obligated to indemnify Papa Johns Bulgaria for any damages resulting from the use of the provided services by third parties to whom the USER has provided their password or secret question and answer in violation of these General Terms and Conditions.
13.3 Parents exercising parental rights, guardians, or custodians of a minor are responsible for all damages caused by the minor to Papa Johns Bulgaria and third parties during the registration and use of the services covered by these General Terms and Conditions, as well as for any damages resulting from providing false information or the falsehood of the declaration in section 4.3.2, last sentence.
14.1 Except in cases provided for in these General Terms and Conditions, the contract between the parties is also terminated upon the occurrence of any of the following circumstances:
a/ cessation of operations by Papa Johns Bulgaria or termination of maintenance of the website www.papajohns.bg;
b/ mutual agreement of the parties to terminate the contract;
c/ other cases provided by law.
14.2 In the event of termination of the contract between the parties on any grounds, Papa Johns Bulgaria has the right to immediately suspend the USER's access to their profile, terminate their registration, and delete all User Content posted by the USER from its servers, in compliance with applicable legislation. In the case of termination of the contract, Papa Johns Bulgaria is not responsible for any damages or lost profits suffered by the USER or third parties resulting from the suspension of the USER's access to their profile, termination of their registration, deletion of User Content from Papa Johns Bulgaria’s servers, or providing information or executing orders from competent state authorities.
15.1 Written or electronic statements and notifications specified in the contract and these General Terms and Conditions are considered valid if made in the form of a letter with a return receipt, facsimile, email, by clicking a virtual button on the website www.papajohns.bg, or similar methods, provided that the statement is technically recorded in a manner that allows it to be reproduced.
15.2 By accepting these General Terms and Conditions and entering into a contract with each other, the parties agree that electronic statements sent between them are considered received upon entry into the designated information system of the recipient, without the need for explicit confirmation. When Papa Johns Bulgaria is the recipient of the statement, it is considered received upon its entry into Papa Johns Bulgaria’s POP3 servers. When the USER is the recipient, the statement is considered received upon its entry into the email inbox provided by the USER during registration, located on a server within the relevant domain. If the USER has provided an invalid email address, the statement will be considered received upon dispatch by Papa Johns Bulgaria, even if it was not actually received.
15.3 The parties agree that if any clause of these General Terms and Conditions is found to be invalid, it does not affect the validity of the contract, other clauses, or parts thereof. The invalid clause will be replaced by mandatory legal norms or established practice.
15.4 The website www.papajohns.bg is maintained by Papa Johns Bulgaria using technical equipment located within the Republic of Bulgaria. Papa Johns Bulgaria does not guarantee or accept responsibility for the accessibility and proper provision of the services on www.papajohns.bg outside the territory of Bulgaria. Specifically, in areas where delivery is not available, only unpaid services may be used. If the USER utilizes the services covered by these General Terms and Conditions outside the territory of Bulgaria, the USER is solely responsible for complying with the applicable legislation in the location where the services are used.
15.5 For any matters not addressed by this contract, the provisions of the current legislation of the Republic of Bulgaria shall apply.
15.6 According to current legislation, the sale of alcohol is prohibited to individuals under 18 years of age. In case of doubt during the finalization and delivery of an order, the customer is required to provide and show their ID card. If the customer is under 18 years of age, the alcohol will not be delivered and will be returned to the delivery zone establishment.
15.7 If a customer wishes to cancel an order, this can be done within 3 minutes after it is accepted. The cancellation can be processed by calling 0700 19 000. If the customer cancels after the 3-minute mark, Papa Johns Bulgaria reserves the right to refuse to fulfill the next order from that customer.
16. All disputes between the parties will be resolved in a spirit of understanding and goodwill. If an agreement cannot be reached, any unresolved disputes arising from these General Terms and Conditions or related to them, including disputes arising from or relating to their interpretation, invalidity, performance, or termination, as well as disputes regarding the filling of gaps or adjustments to new circumstances, will be resolved through negotiations, and if an agreement is not reached – through judicial proceedings.
